DATA DEFINITIONS
Data Element Description
CASE/INVESTIGATION NUMBER The investigation number is assigned sequentially for each State and fiscal year.
TOTAL SETTLEMENT AMOUNT Total dollar amount settled for all violations cited in the enforcement case.
CLOSED DATE The closed date is the earliest occurrence of one of the methods of closure. All methods of closure and their effective dates are listed on the lines following "Closed Date". These methods are as follows:
FULL PAYMENT RECEIVED: When the total amount of debt from Notice of Claim, Agreement or Final Order is collected.
SETTLEMENT AGREEMENT: The document executed between the FMCSA and the respondent stating the amount of the penalty agreed upon, and the number and timing of payments.
CONSENT ORDER: A procedure in which both parties (Respondent and Claimant) involved in the civil forfeiture process have agreed to execute an agreement to dispose of a case (e.g., a signed Compliance Order).
FINAL ORDER **AC**: When the FMCSA Acting Chief Safety Officer for the Federal Motor Carrier Safety Administration (FMCSA) issues a final decision and order based on the evidence and arguments submitted.
FINAL ORDER **FA**: When an FMCSA Field Administrator orders the carrier to comply with the penalty assessment and/or settlement agreement.CRIMINAL CONVICTION: When someone is charged and proven guilty/convicted by a court of law for a criminal penalty (fine or imprisonment).
ENFORCEMENT TOOLS USED: Enforcement methods used in the case/investigation.
NOTICE OF INVESTIGATION: A notice to the respondent that FMCSA has discovered violations of the Federal Motor Carrier Safety Regulations under circumstances which may require a compliance order and/or monetary penalty.
OUT-OF-SERVICE ORDER:The official document used by FMCSA to order a motor carrier to cease all or part of its operation for imminent hazard conditions, imminently hazardous operations, or for being "unfit".
RESTRAINING ORDER: Court order restraining specific actions of the respondent.
ICC INTERVENTION: Any action under the former Interstate Commerce Commission regulations (as currently enforced by FMCSA) to compel an authorized carrier to comply with an order or action of the FMCSA.
ICC REVOCATION: A revocation of permits or authorities under the former Interstate Commerce Commission regulations (as currently enforced by FMCSA).
IMPRISONMENT: When someone is sentenced to a prison term based on a criminal penalty conviction.
SECTION NUMBERS CITED IN VIOLATIONS: The 49 CFR Section number of each of the violations cited in the enforcement case.
SETTLEMENT AMOUNT: The settlement amount for the specific section number cited.
